By accessing or using Clawi.ai ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you do not have permission to access the Service.

The Service is operated by Clawi.ai ("we," "us," or "our"). We reserve the right to modify these Terms at any time. Your continued use of the Service following any changes constitutes acceptance of those changes.

2. Description of Service

Clawi.ai provides a managed hosting service for personal AI assistants powered by OpenClaw technology. The Service allows users to:

• Host a personal AI assistant running 24/7 in the cloud
• Connect to various messaging platforms (WhatsApp, Telegram, Discord, etc.)
• Access AI model capabilities through OpenRouter integration
• Manage credits and billing through our platform

3. Experimental Nature of Service

• No guarantee of availability: We do not guarantee that the Service will be available at all times. Outages, maintenance, and unexpected downtime may occur.
• Third-party dependencies: The Service relies on third-party services including OpenRouter, Anthropic, OpenAI, and others. Failures or changes to these services may affect functionality.
• Bugs and errors: As experimental software, bugs may occur. Your AI assistant may produce unexpected results, fail to complete tasks, or behave unpredictably.
• AI limitations: AI assistants may produce incorrect, inappropriate, or harmful outputs. You are responsible for reviewing and validating any actions taken by your assistant.

4. User Accounts

To use the Service, you must:

• Be at least 18 years old
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access to your account

You are solely responsible for all activities that occur under your account.

5. Payment Terms and Refund Policy

Payment terms:

• Credits are purchased in advance and applied to your account balance
• Purchased credits do not expire and remain in your account until used
• Subscription plans are billed in advance on a monthly basis
• You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period
• We reserve the right to modify pricing with 30 days' notice

6. Acceptable Use Policy

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Generate, distribute, or facilitate illegal, harmful, or abusive content
• Infringe on the rights of others
• Attempt to gain unauthorized access to our systems or other users' accounts
• Engage in any activity that interferes with or disrupts the Service
• Use the Service for spam, phishing, or other deceptive practices
• Circumvent or manipulate billing, security, or access controls

We reserve the right to terminate accounts that violate these policies without refund.

7. Intellectual Property

The Service, including its original content, features, and functionality, is owned by Clawi.ai and is protected by international copyright, trademark, and other intellectual property laws.

Content you create using the Service remains yours. By using the Service, you grant us a limited license to process your content as necessary to provide the Service.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

We do not warrant that the Service will be uninterrupted, secure, or error-free. We make no warranties regarding the accuracy or reliability of any AI-generated content or actions.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CLAWI.AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.

Our total liability for any claims arising from your use of the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Clawi.ai and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service or violation of these Terms.

11. Termination

We may terminate or suspend your account immediately, without prior notice, for any reason, including breach of these Terms. Upon termination:

• Your right to use the Service will immediately cease
• We may delete your account data (subject to our Privacy Policy)
• Unused credits will be forfeited

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

13. Dispute Resolution

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Delaware, and the arbitrator's decision shall be final and binding.
